Should arbitral rules provide
guidelines on the factors
that arbitrators should take
into account when
determining costs?

Over half of respondents (53%) think that
arbitral rules should provide guidelines on
the factors that arbitrators should take into
account when determining costs, while
approximately one-third believe this should
be left to the discretion of the arbitrators
and 14% would maintain the current system
(where some arbitral rules provide guidelines
and others do not). This shows that greater
predictability is sought than is currently
provided by the various arbitral rules.
