How often are experts directed
to confer in advance of the hearing?

As Chart 31 illustrates, expert witnesses
are rarely directed to confer in advance of
the hearing in order to identify the issues
on which they agree/disagree. Over half
of respondents said that this happened
in only 0-25% of their arbitrations.
