Should improper conduct
by a party or its counsel be
taken into account when
allocating costs?
The survey indicates that there is significant
support for the use of costs allocation as a tool
for encouraging efficient and proper conduct
of the proceedings. An overwhelming majority
of respondents (96%) believe that improper
conduct by a party or its counsel during the
arbitral proceedings should be taken into
account by the arbitral tribunal when allocating
costs. This sends a strong message to
arbitrators that they are expected to penalise
improper conduct by parties and their counsel
when allocating costs.
