The vast majority of respondents (92%)
believe that fact witness evidence should
not be eliminated as a form of evidence in
international arbitration – because either it
is ‘generally an effective form of evidence’
(70%) or it is ‘a necessary evil’ (22%).
Only 1% of respondents would eliminate fact
witness evidence (7% have no view). More
common lawyers (78%) than civil lawyers
(61%) think that fact witness evidence is an
effective form of evidence.
